Terms of Service

By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services. You must be at least 18 years old. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to that organization.

• Services — the Mindcase console, developer API, agents, and website.
• Agents — the configurable data agents you run to collect structured data from third-party, public-facing platforms.
• Output — the datasets and API responses delivered to you as a result of a run.
• Credits — the prepaid balance you top up and that is consumed as you run agents.

Authentication is provided through Clerk (Google, Microsoft, or email sign-in). You are responsible for maintaining the confidentiality of your credentials and API keys, and for all activity that occurs under your account. Notify us at support@mindcase.co if you suspect unauthorized use.

Mindcase lets you run agents through the console at console.mindcase.co and through our API. The agents collect structured data from third-party, public-facing platforms (such as marketplaces, social networks, review sites, search engines, maps, and real-estate sites) and deliver it to you as Output. Mindcase is a general-purpose extraction tool — you decide which agents to run, direct what data to collect, and own the Output. Mindcase is not a data broker and does not sell datasets, and we do not determine the purposes of the data you choose to collect.

You are solely responsible for how you use the Services and the Output. As a condition of using the Services, you agree that you will:

• only collect and use data that you have the right to collect and use;
• comply with all applicable laws, including privacy and data-protection laws;
• comply with the terms of service and acceptable-use rules of the source platforms from which data is collected;
• not use Output to harass, stalk, defraud, discriminate against, spam, or unlawfully profile any person;
• not use the Services for any unlawful, deceptive, or harmful purpose;
• not abuse the infrastructure, circumvent pricing or usage limits, evade rate limits, or attempt to access the Services in an unauthorized way.

Mindcase provides a neutral data-collection tool and does not direct or control how you use the Output. You bear sole responsibility for the lawfulness of your use. We may suspend or terminate accounts that breach this policy.

The Services are billed on a prepaid credit model. You top up a credit balance and are charged per result/row at per-agent pricing. There is no subscription and no auto-renewal.

• Charges are processed by our payment processor, Razorpay, in the currency shown at checkout, plus any applicable taxes.
• You are charged per delivered result. Duplicate rows and failed rows are not charged.
• Per-agent pricing and the agents available may change. Changes apply to runs made after the change takes effect.

Refund and cancellation terms are described in our Refund & Cancellation Policy, which is incorporated into these Terms by reference.

The Services are provided on an “as is” and “as available” basis. We may add, change, or remove agents, pricing, and features at any time. Some features may be offered as beta and may change or be discontinued without notice. We do not guarantee that the Services will be uninterrupted or error-free.

Mindcase owns all rights in the platform, software, agents, and brand. We grant you a limited, non-exclusive, non-transferable license to use the Services as permitted by these Terms. Subject to any third-party rights in the underlying data, you own the Output you generate. You grant us the limited rights necessary to operate the Services and deliver your Output.

Output originates from third-party platforms and is provided to you “as is.” We make no warranty as to the accuracy, completeness, currency, or legality of the underlying source data. Mindcase is not affiliated with, endorsed by, or sponsored by any of the third-party platforms from which data may be collected. All third-party names, logos, and trademarks are the property of their respective owners.

To the maximum extent permitted by law, the Services and Output are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, Mindcase will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Services. Mindcase’s total aggregate liability arising out of or relating to the Services will not exceed the amounts you paid to Mindcase in the twelve (12) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless Mindcase and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use or misuse of the Services or Output, your breach of the Acceptable Use Policy, your violation of any law, or your infringement of any third-party rights.

We may suspend or terminate your access to the Services, in whole or in part, if you breach these Terms or the Acceptable Use Policy, fail to pay amounts due, or use the Services in a way that risks harm to Mindcase, other customers, or third parties. You may stop using the Services at any time.

Each party may have access to non-public information of the other. Each party agrees to protect the other’s confidential information with reasonable care and to use it only as needed to perform under these Terms.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
• Entire agreement. These Terms, together with the policies referenced in them, are the entire agreement between you and Mindcase regarding the Services.
• Notices. We may provide notices through the platform or by email. Send notices to us at support@mindcase.co.
• Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
